Apple and Prepear Negotiating Settlement Over Logo Dispute

Last summer Apple made headlines after it filed a trademark opposition against recipe and meal-planning app Prepear. The California-based tech powerhouse objected Prepear’s logo trademark, noting the similarity to its own logo, “Applicant’s Mark consists of a minimalistic fruit design with a right-angled leaf, which readily calls to mind Apple’s famous Apple Logo and creates a similar commercial impression. The Apple Marks are so famous and instantly recognizable that the similarities in Applicant’s Mark will overshadow any differences and cause the ordinary consumer to believe the Applicant is related to, affiliated with or endorsed by Apple.” In protest, the company behind Prepear, Super Healthy Kids, put together a petition to persuade Apple to drop its opposition, which received over 250,000 signatures.

According to reports, despite Apple not dropping its opposition, it appears a resolution is currently in the works. In revealed filings with the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board, Apple requested that trial proceedings be suspended for 30 days (January 23) as the “parties are actively engaged in negotiations for the settlement of this matter.”

If a settlement is not reached, the opposition against Prepear’s logo trademark will head into initial pretrial disclosures in March with main trials set to begin in October and a potential request for an oral hearing held until December 2021.
